Can a co-signer take a car back? I have never missed, or been late on a payment. She wants to sell it?

I had someone co-sign on a car for me two yrs ago and she is threatening to take the car and sell it. I have NEVER missed, or been late on a payment and obviously need my car. Can she legally take the car away from me? I cannot refinance it because of my credit. (I owe about 15K in medical collections).

  1. A co-signer is someone who will be responsible for making your payments if you fail to do so. If you stop making your payments, the bank will come after both of you. As far as I know, she cannot take your car away from you unless her name is on the title.

  2. A co-signer only guarantees payment, the cosigner is not the primary on the title, and therefore has no legal leg to stand on in regards to return or sale of said vehicle so long as you continue to make the payments on time.

  3. She has no legal grounds to take your car as long as your payments are up to date.The car is in your name right?As long as your creditor is getting their money they are happy and not going after your co-signer so she’s out of luck.

  4. No she can’t. Co-signing is an acceptance of financial responsibility, and does nor imply ownership or possession. If she takes the car, that’s car theft.
